Terms and Conditions

1. In these terms and conditions "student" means any registered student member of Online Language Labs Ltd. (OLL) and "tutor" means any registered teaching member of OLL.  EnglishLab.com is the fully owned website of OLL and in these terms and conditions the use of the term Online Language Labs Ltd. shall also be understood as referring to EnglishLab.com.

2. By confirming during registration that you have read these terms and conditions and whilst continuing to register as a member of OLL you are notifying your acceptance of these terms and conditions and that they shall be binding in all circumstances in relation to your use of the service provided by OLL.

3. Students commit to behaving appropriately at all times during lessons and in the course of any communication with tutors and accept that OLL will consider any inappropriate behaviour as a serious and fundamental breach of agreement and may terminate their membership at any time if OLL has reason to believe that they have behaved inappropriately without the necessity for OLL to define or justify the reason for its decision.

4. OLL reserves the right to monitor lessons and all communications without notice to the student for the purpose of ensuring the security of OLL and to ensure the safety of tutors and students.

5. OLL reserves the right to take and retain a screenshot or screenshots of students during each lesson that the student takes part in without notice to the student for the purposes of security and for communication only with tutors for the purposes of lesson records.

6. Users agree not to make any attempt to contact tutors other than through the mechanisms supplied by OLL and that any attempt to do so will be considered a serious and fundamental breach of these terms and conditions and may lead to immediate termination of their membership without refund of any monies related to lesson credits outstanding.

7. Lesson credits must be used to take lessons within three months of the date that they were purchased. The lesson credits will expire if the lessons are not taken within three months of the date of purchase and except in exceptional circumstances at the sole discretion of OLL no refund will be given.

8. OLL and the student agree that once lesson credits have been purchased lessons will be provided by OLL to the student irrespective of any change in pricing that may occur between the date of purchase of the credits and the date of lessons taken using those credits. 

9. Lesson credits once purchased are not refundable for their monetary value and it is the responsibility of the student to ensure that they are able to use the lesson credits to take lessons within the lifetime of the credits.

10. These terms and conditions establish privacy of contract between OLL and the student only and the lesson credits may only be used by the student who originally purchased the lesson credits and cannot be transferred assigned or negotiated to or with any other third person who is not a party to these terms and conditions.

11. Lesson bookings may be cancelled up to 24 hours before the lesson is due to start and the lesson credit will be re-allocated to the student's account for the purposes of booking further lessons.

12. Lessons may not be cancelled by the student less than 24 hours before a lesson is due to start. If the lesson is not taken by the student the lesson credit will not be re-instated to the student's account.

13. In the event that a tutor has to cancel a lesson booking the tutor will contact the student via the website to inform them and the lesson credit will be re-allocated to the student's account.

14. In the event that a tutor fails to attend a booked lesson or does not complete the lesson then the student should contact OLL by email within 24 hours of the end time of the lesson. OLL will investigate the situation and the lesson credit will be refunded to the student's account if the details of the case are as stated by the student and the cancellation or non-completion of the lesson was the responsibility of the tutor.

15. OLL will at all times endeavour to ensure that the technical quality of its service is of the highest quality appropriate to the method of communication but will not be held responsible for technical problems experienced by students with their own equipment or with communications over the internet or such other causes which are outside of their control.

16. Any complaint that the student has with the service provided must be communicated by email using the email facility on the OLL website within 24 hours of the end of the lesson concerned.

17. OLL will not be held liable to the student his or her agent or any other third party for any consequential loss whatsoever that may be claimed as a result of the service it provides or any deemed failure to provide that service.

18. OLL reserves the right to amend the Terms & Conditions at any time and to notify all students via either email correspondence or other appropriate means.
